27.24 R4 Districts - Multiple Family Dwelling
27.24.010 Permitted uses.

27.24.010 PERMITTED USES. Use of buildings or land in this district and buildings hereafter erected, structurally altered or enlarged, shall be limited to the following:
(a)  Any use permitted in the R1, R2, or R3 districts;
(b)  Accessory uses which are necessary to the above-mentioned buildings and uses. (Ord. 1991-18 § 9, 1991; Ord. 1985-3 § 3 (part), 1985: prior code § 146.05(A)).

27.24.020 SPECIAL USES. Unless otherwise provided the following uses may be permitted subject to the approval of a special use permit by the planning commission:
(a)  Any special use permitted in the R3 district;
(b)  Boarding and lodging houses;
(c)  Private clubs, lodges, and fraternal organizations including the serving of food and beverages to members and their guests, and including such other facilities customarily provided for the comfort and convenience of the membership.
(d)  Fraternity and sorority houses;
(e)  Hospitals and sanitariums, but not including animal hospitals;
(f)  Philanthropic or eleemosynary uses or institutions, provided that not more than twenty percent (20%) of the gross floor area or two thousand (2,000) square feet, whichever is greater, shall be used as office space.
(g)  Hotels/motels on existing motel sites along North Bayshore Boulevard from East Popular Avenue to Cypress Avenue. (Ord. 1999-18 § 1, 1999; Ord. 1992-15 § 15, 1992; Ord. 1991-18 § 10, 1991; Ord. 1985-3 § 3 (part), 1985; Ord. 1982-22 § 28, 1982: prior code § 146.05(B)).

27.24.030 OFF-STREET PARKING. Off-street parking facilities shall be provided as required in the off-street parking code (Chapter 27.64). (Ord. 1985-3 § 3 (part), 1985: prior code § 146.05(C)).

27.24.040 MINIMUM DEVELOPMENT STANDARDS. (a) Every dwelling hereafter erected or structurally altered to create one or more additional dwelling units shall be on a parcel having the following minimum development standards:

* These standards are permitted only if a parcel is lying northeasterly of El Camino Real and was recorded prior to March 3, 1947.

(b)  A larger minimum parcel for special uses shall be required by the planning commission upon a finding that the minimum parcel does not adequately accommodate the proposed special use. 27.24.050 MAXIMUM FLOOR AREA RATIO. The floor area ratio of buildings and structures on a parcel in this district shall not exceed 1.5, except that the zoning administrator may grant permission to exceed the above maximum floor area ratio, using the procedures outlined for special uses as provided in this title, if the additional floor area will:
(1)  Not exceed a floor area ratio of 2.0,
(2)  (A) Be equal to the additional floor area that is required to cover any parking space that is not otherwise required to be covered by provisions of this title, or
(B)  Is necessary to cover any required turnaround area for required parking, and
(C)  Increase the livability by providing more usable yard area than could be provided without the permitted increase in floor area. (Ord. 1991-18 § 12, 1991; Ord. 1991-12 § 63, 1991; Ord. 1985-3 § 3 (part), 1985: prior code § 146.05(E)).

27.24.055 BUILDING HEIGHT. Building height shall not exceed the standards set forth on the Building Height Plan of the General Plan. (Ord. 1991-18 § 13, 1991).

27.24.060 YARD AREAS. Unless otherwise provided in this chapter, the regulations in the R3 district shall apply. (Ord. 1985-3 § 3 (part), 1985; prior code § 146.05(F)).
